Conduct Rules Review: Individual User

Employees will need to complete an electronic Self-Declaration as part of the Conduct Rules Review process. The Self-Declaration will then be sent to one or more Managers within the organisation.

Navigate to your Conduct Rules Review

You will receive as a system-generated email message asking you to sign in to Diligent Entities.

Note

Your access rights will determine which icons display on the Banner and/or tabs on your Portal. However, your pending review will always be located under the My Reviews tab on the My Home page.

  • Select the link provided in the email to sign in to Diligent Entities. The My Reviews page will display, where you will find your pending Conduct Rules Review.
  • Select the Open Folder icon adjacent to your name (or on your name, listed in the Entity column) to open the pending Conduct Rules Review.

Conduct Rules Review

Employees will receive a Conduct Rule Review applicable to their role, that is a Review based on the function(s) you perform within the company. Senior Managers, for example may be asked to agree to the following set of Conduct Rules as part of their review.

Individual and Senior Manager Conduct Rules

The Conduct Rules assigned to each employee is based on their Tier within the entity. If the individual is a Senior Manager, they will be asked to agree to both the Individual Conduct Rules and Senior Manager Conduct Rules.

If the individual is not a Senior Manager, they will only have to agree to the Individual Conduct Rules.

Individual Conduct Rules

The Individual Conduct Rules consists of the following statements:

  • You must act with integrity.
  • You must act with due skill, care and diligence.
  • You must be open and cooperative with the FCA, the PRA and other regulators.
  • You must pay due regard to the interests of customers and treat them fairly.
  • You must observe proper standards of market conduct.

Senior Manager Conduct Rules

In addition to the Individual Conduct Rules statements, the Senior Manager Conduct Rules include the following for an 4 statements:

  • SC1: You must take reasonable steps to ensure that the business of the firm for which you are responsible is controlled effectively.
  • SC2: You must take reasonable steps to ensure that the business of the firm for which you are responsible complies with the relevant requirements and standards of the regulatory system.
  • SC3: You must take reasonable steps to ensure that any delegation of your responsibilities is to an appropriate person and that you oversee the discharge of the delegated responsibility effectively.
  • SC4: You must disclose appropriately any information of which the FCA or PRA would reasonably expect notice.

Completing the Review

  • Once you have reviewed the applicable Conduct Rules, select Agree.

The review will be updated to indicate the date completed and a copy of the record will be sent to the applicable managers.
